We recently received a compliance notice from the Maryland Department of Environment (MDE) related to sediment/erosion management and documentation procedures at The Village at Providence Point construction site.
The notice identified one field-related issue involving mud tracked onto Forest Drive by construction vehicles on February 12, 2026. The MDE report noted the affected area was clean and that no further corrective action is required with respect to that matter.
The remaining items outlined in the notice primarily involve administrative and procedural components of our Stormwater Pollution Prevention Plan (SWPPP). These include inspection frequency and documentation protocols, ensuring records are properly signed and dated, confirming the posting of required information such as construction office hours, and maintaining complete documentation files onsite. While these items are largely related to record keeping and process compliance rather than deficiencies in erosion or sediment controls, we recognize that accurate documentation is an essential part of environmental stewardship and regulatory compliance.
In response, our construction management team and environmental consultants reviewed the notice and promptly updated the on-site binder to ensure all required signatures, certifications and project information — including business hours — are properly documented. Inspections are conducted on a regular schedule of every four days; however, state holiday closures around Christmas and New Year, along with official weather-related shutdowns during recent snow and ice events, raised safety issues and affected the timing of certain inspections. Inspection scheduling has since been adjusted to ensure full alignment with the four-business-day requirement.
Environmental compliance is a core priority for this project. As construction progresses, we remain committed to meeting or exceeding all applicable local and state environmental regulations, maintaining effective erosion and sediment controls, and operating in a manner that protects surrounding roadways, waterways, and neighboring properties. We will continue to work proactively with regulators to ensure the site remains in full compliance throughout the construction process.
